1. If not otherwise stated, prices are net of discount and ex our factory.
2. Standard packages included in price . Additional packing at cost price.
3. Goods are carried at buyer’s risk. In case of damage or lack of goods, buyer will immediately proceed against the carrier. Goods are not covered by any type of insurance, if not expressly requested by the buyer. Insurance cost shall be at buyer’s ex- penses. Goods will be checked upon receipt, claims made after 8 days from receipt will not taken into consideration.
4. In case of mistake or manufacturing defects which are made known within 8 days from receipt of goods and are acknowledge by us as such defective goods will be replaced without giving right to any indemnity, compensation, reimbursement for direct and consequential damages. Defective goods will be replaced as quickly as possible. Unauthorized returns of goods are not admitted. Delays in payment by the buyer will suspend or avoid any guarantee.
5. Delivery terms are approximate and depend on the means available at that moment, possible delay will not entitle the buyer to request either any compensation, indemnity or reimbursement for direct and consequential damages or to cancel the order.
6. Order cancellations are not accepted, if not agreed previously, and in any case the supplier in entitled to request the reim- bursement for charges borne because of such cancellations.
7. We decline any liability for accidents to persons and property which may occur by reason or in consequence of products sup- plied by us. This applies also to accidents which may occur during testing.
8. Invoices are to be understood fully accepted if they are not rejected within 5 days from their arrival. In no case the buyer may refuse to receive the goods or make the payment, subject to have his claim recognized later on. In case of delayed payment with respect to agreed dates overdue interests equal to the official discount rate, raised by 8% shall be calculated.
9. Any dispute shall be settled by the Court of Monza even if the agreement was drawn elsewhere. 10. We mean the conditions accepted on the order.
